Real Estate Brokerage Disclosures and Limitations

a. Licensed Brokerage in Oregon
Carey and Bend Realty is a real estate brokerage licensed in the State of Oregon under the principal broker Carey Greiner. All services are provided in accordance with Oregon law, including but not limited to ORS Chapter 696 governing real estate licensing and practices.

b. Scope of Services
Carey and Bend Realty provides real estate brokerage services on a flat-fee basis for both sellers and buyers. The services are limited to facilitating the sale or purchase of real property in Oregon and are delivered through a combination of digital tools, communication, and documentation via our platform.

c. No Fiduciary or Exclusive Representation
Carey and Bend Realty operates solely as a limited agent or transaction facilitator, not as a fiduciary. Clients acknowledge and agree that we do not offer exclusive buyer or seller representation unless explicitly agreed to in a separate written agreement. We do not assume the legal duties of loyalty, confidentiality, or advocacy associated with traditional full-service representation.

d. No MLS Submission or Syndication
Listings submitted through Carey and Bend Realty are not published to any public Multiple Listing Service (MLS) or syndicated to third-party platforms such as Zillow, Redfin, or Realtor.com. Properties are published exclusively on the Bend Realty website unless otherwise disclosed.

e. Client Responsibilities and Due Diligence
Buyers and sellers acknowledge that it is their sole responsibility to conduct appropriate due diligence related to any transaction, including but not limited to property inspections, appraisals, environmental assessments, title searches, and neighborhood or zoning research. Carey and Bend Realty does not verify or warrant the condition, marketability, or suitability of any property.

f. Market Risk Disclaimer
Real estate market conditions are inherently variable. Carey and Bend Realty makes no guarantee or prediction regarding offer amounts, time on market, buyer activity, final sale price, appraisal results, or closing timelines. Clients understand that outcomes may be affected by market fluctuations, economic changes, buyer preferences, and other uncontrollable factors.

g. Flat-Fee Structure and Non-Contingent Payment
All brokerage services are provided on a flat-fee basis, regardless of the final sales price or closing outcome. Fees are not contingent on sale success, and clients agree to remit payment as outlined in the service agreement. Refunds will not be issued after services are initiated, except as required by Oregon law.

h. Third-Party Providers and Referrals
Carey and Bend Realty may provide a list of recommended service providers such as contractors, mortgage brokers, title companies, or inspectors upon client request. These referrals are made for convenience only. Carey and Bend Realty does not receive referral compensation, and makes no representations or warranties regarding the quality, availability, or performance of any third-party providers. Clients assume full responsibility for evaluating and selecting all third-party vendors.

i. Document Handling and Digital Signatures
All transaction-related documents are handled through Carey and Bend Realty’s proprietary software. Clients agree to receive and sign documents electronically unless otherwise arranged in writing.

j. Compliance with Oregon Law
All clients agree to comply with applicable state and local real estate laws. Carey and Bend Realty reserves the right to decline or terminate service if any activity appears to be unlawful, misleading, or in violation of Oregon’s real estate statutes or ethical guidelines.
